This is a translation from the German version of this text. In the case of conflict between the English and German versions, the German version shall prevail.

1. Scope of application/ Reservation of right to change

The following General Terms of Use apply to the use of the contents and functions on the website www.mele-erasmus.eu (hereinafter: “Portal”) operated by the Europa-Institut, Law Department of Saarland University (hereinafter: “Europa-Institut”), in particular also to the contents requiring registration. Within the framework of the contract for the use of our content that exists through the use of our website, you are permitted to use this content and functions for your own purposes free of charge within the framework of these Terms of Use. The use of certain content or features may be subject to special terms and conditions. Such separately identified terms and conditions shall then apply in each case in addition to these Terms of Use.

The Europa-Institut reserves the right to change the Terms of Use at any time and to make the further use of the portal, in particular of the content requiring registration, dependent on your agreement to the changed Terms of Use. 

2. Copyrights

The contents provided on the portal are protected by copyright. The Europa-Institut makes this content available free of charge and exclusively for the user’s own, non-commercial purposes, provided that no copyright notices or other designations are removed and the content is not edited or changed in any other way. Use is only permitted if the Europa-Institut is noted as the author. Any use of the contents of the portal for commercial or public purposes, in particular by including them in external internet offers, e.g. by means of a hyperlink in a frame, requires the prior written consent of the Europa-Institut. 

3. Registration

Access to certain areas and/or functions of the portal requires registration of the user. The name given at the time of registration will also be shown when using the comment function, provided that the user is logged in at that time.

The information registered for the user can be changed or updated at any time in the personal area.

The user is responsible for ensuring that his password is not accessible to third parties. The user assumes full responsibility for all actions taken using his login name in conjunction with his password.

Any misuse of the user’s login name/registration data that becomes known to the user must be reported to the Europa-Institut immediately and must be prevented by changing the user’s login information.

Each registered user may terminate his registration at any time and without notice. To terminate, it is sufficient to send an e-mail to projects@europainstitut.de.

4. Provision of contents and functions

The Europa-Institut reserves the right to change, terminate or remove content and functions in whole or in part at any time and/or to discontinue operation of the portal altogether at any time.

The Europa-Institut does not guarantee uninterrupted availability of the portal. In the event of availability problems, the Europa-Institut will endeavor to remedy any disruptions within its sphere of responsibility without delay.

5. Rules regarding contents and functions

(a) Own contents

The content available on the portal has been created or editorially checked in accordance with the usual standards of care.

(b) Linked contents

The contents of external websites that can be reached via hyperlinks from the portal or that refer to this site are third-party contents over which the Europa-Institut has no influence and for which no warranty is assumed.

(c) User-generated content and comment function

The Europa-Institut is not responsible for the topicality, correctness and/or completeness of the content, nor for the individual usefulness of the content of external registered users.

The Europa-Institut provides a comment function for selected contributions. For this we need your name or a pseudonym. This is to promote a more transparent and individual communication between authors and/or commentators. We also collect your e-mail address. Storage of this information serves to avoid spam. The disclosure of the data you provide in this context is expressly on a voluntary basis and with your consent. We use the personal data thus transmitted exclusively for the purpose for which you provide us with your data. Of course, you can revoke your declaration of consent at any time for the future. To do so, please send an e-mail to projects@europainstitut.de.

The comment function is intended to enable a more extensive and factual debate between users. Such a debate can only be guaranteed if users treat each other fairly and, in particular, tolerate dissenting opinions of other users.

In addition, the comments posted by users must not violate applicable law and/or morality. In particular, pornographic content, content that glorifies violence, content that incites hatred, content that incites people to commit crimes, instructions to commit crimes and content that is likely to offend the political or religious beliefs of third parties violate applicable law and morality.

Furthermore, comments posted by users may not violate the rights of third parties. Third party rights are in particular personal rights of persons and companies as well as rights to names, trademarks and copyrights, which the user may not dispose of.

Advertising for services/offers of third parties expressed in the comments is not permitted.

If and insofar as the Europa-Institut becomes aware of violations of the above rules, the corresponding comments will be removed by the editorial team. Furthermore, the Europa-Institut reserves the right to permanently exclude users who violate the rules from using the comment function at any time.

Furthermore, the Europa-Institut does not adopt the comments posted by users within the framework of the comment function on the portal as its own and does not vouch for the legality, accuracy of content or other correctness of such content. The Europa-Institut would like to point out that comments are not individually checked before publication. In general and irrespective of the existence of a rule violation, the Europa-Institut reserves the right to remove comments at any time and at its own discretion.

6. Liability

Subject to the following provisions, the Europa-Institut shall be liable for the portal in accordance with the statutory provisions.

In the event of slight negligence, the Europa-Institut shall only be liable for all claims for damages and reimbursement of expenses directed against the Europa-Institut due to a breach of duty for which the Europa-Institut is responsible in the event of a breach of essential duties that jeopardizes the purpose of the contract. Otherwise, the liability of the Europa-Institut for slight negligence is excluded. In the event of liability according to the above and liability without fault, the Europa-Institut shall only be liable for typical and foreseeable damage.

The above limitation of liability shall not apply in the case of strict liability and for damages due to injury to life, limb or health.
